What should I consider when selecting an EB-5 immigration attorney?
Video Transcript
There’s going to be no shortage of immigration firms that want to help you, but what you want to find is a law firm that really specializes in EB-5. Don’t just ask them about how many years they’ve been practicing. How many petitions have they filed throughout the years? How many cases they have filed recently? Even though you’ve been in practice for 30 years, you’ve filed five cases a year. That doesn’t really help you very much, and the reason why is EB-5 itself is a very specialized program in the immigration world. There’s only one team of adjudicators in Washington, D.C. at the IPO (Immigrant Investor Program Office) that reviews them. So whoever is working on your case must be able to track these trends real time. What is the agency concerned with? What are some common RFE (request for evidence) issues? What’s really approvable out there? Unless you’re a law firm that is constantly immersed in EB-5 day in, day out they might not be able to actually help provide you with that. Another thing is when you are working with a law firm, who exactly in the law firm will be working with you? The process should be transparent when we have the consultation. What are your goals? What do you want to do in the next year or so? We time our process, we time our filing around where our investors are in their lives. Some of you may be on here in H-1B preparing to switch jobs or want to start your company and you want to get filed faster. So when you work with us, you will have access to all three EB-5 partners, assigned a paralegal and legal assistant. We will work with you as you select your project. We will work on the forms and the source of funds together, as we review the project that you’re invested in as well.
