So a common question we get asked is: “Does a EB-5 investor have to invest the full amount before they follow the I-526E petition?” The short answer to that is no. There is no requirement that you have to invest the full amount. Typically, what it is that we can actually submit your case based on your partial investment and explain to the government that you are committed, or in the process of actively investing. So this is important because in today’s age, with many of our investors, you may have $800,000 or $900,000, but you may not be able to get it all at once. If you’re working with a law firm like us, that typically falls within 4 to 6 weeks, one of the things that we will do is we will file your case based on a partial investment first, explain to the government that this is a sum you’re investing now, and this is the amount that you will be investing in the future for a variety of reasons. That allows you to get to file your case, get your priority date, and get your place in line faster, and begin your life in the U.S. Later on when you figure out where you’re going to source the rest of your money we will work with you to prepare a supplemental filing, coordinate with the project you invested in, and submit that to USCIS.
